NAIROBI, Kenya Jul 6 – A Nairobi businessman has been arrested after he opened fire following an accident involving another motorist, in the Central Business District on Tuesday night.
The trader is being detained at the Central Police station and was expected to be arraigned in court on Wednesday afternoon.
“He will be taken to court once we finalise our investigations. He will be in court this [Wednesday] afternoon,” Nairobi Central divisional Police chief Eric Mugambi said.
The trader was identified as Elly Owuor in the Central Police station’s Occurrence Book.
Police were yet to determine charges to be preferred against the businessman but a detective with knowledge of such case told Capital News it could range from attempted murder, misuse of a firearm or driving dangerously – depending on the circumstances.
The trader who is a licensed firearm holder caused drama on Kenyatta Avenue at about 3am on Tuesday night when his Mercedes Benz collided with a white saloon car.
A man who was driving the saloon car told police he was racing towards Uhuru Highway when the motorist joining from Koinange street junction hit his vehicle.
“When I came out, he immediately drew a gun and shot several times in the air. That is when I lay on the ground to avoid being hit by the bullets but he continued shooting and one of the bullets hit my car,” the man told Capital News soon after recording a statement at the station on Wednesday morning.
Two police officers on patrol rushed to the scene and ordered both of them to drive to the central police station. Records at the central police station show that he shot six times.
“Each of the police officers boarded the vehicles but the motorist who was armed defied the orders and sped off with our officer on board, that is where he was arrested after being subdued with reinforcement of other officers,” a police officer at the central police station said.
The businessman was then disarmed and his vehicle driven to the station where he spent the night.
“We are taking him to hospital to determine if he was drunk at the time before he goes to court. This is a procedure that has to be done,” Mr Mugambi said.
His black Mercedes Benz, which has a parking sticker of the Kenya National Assembly car park, was slightly damaged on the left side. The vehicle still being held at the station next to the white saloon car on Wednesday. It was also damaged partly on the right side.
Both men were not injured in the accident.
Mr Mugambi said the private firearm license given to the businessman would be revoked if it is determined that the circumstances under which he used it were not justified.
Another businessman who drew a gun and threatened to open fire on Luthuli Avenue earlier in the week was arraigned in court on Tuesday and released on bond.
Mr Mugambi said another man had been arrested for misusing his gun within Kamukunji area.
“Such cases are becoming rampant we don’t know what has become of private licensed firearm holders,” he added.
