A German millionaire accused of bigamy was on Thursday blocked from travelling to his home country on medical grounds.
Principal magistrate Loise Komingoi demanded documents confirming Mr Jurgen Paul Flach’s sickness and the need to travel to Germany for treatment before the court could release his passport.
She said the court could not allow an oral application for Mr Flach to travel to his home country.
Mr Flach’s wife, Mrs Jane Akoth, has accused her husband of marrying another woman before divorcing her and is seeking Sh300,000 monthly allowance.
She also wants the accused to deposit in court her allowance for five years, which amounts to Sh18 million.
His lawyer, Mr Tom Olweny, told the court that his client was unwell due to the stress caused by his arrest and detention and promised that he (Mr Flach) would attend court as required.
Mr Flach was arrested last month at a hotel in the South Coast by police officers who were enforcing a warrant of arrest.
He was then escorted to Nakuru Central Police Station awaiting his prosecution.
On Thursday, Ms Komingoi told Mr Olweny to make a formal application for travel, complete with documents to prove that the man was actually sick and that he could only be treated in Germany.
In his affidavit, Mr Flach has denied that he married the complainant. He said that he and his accuser held an engagement party at a Nakuru hotel and not a wedding ceremony.
He claimed that the marriage certificate issued by the complainant in court was a forgery since he made inquiries at the Registrar of Marriages and was told that no such certificate was issued.
In his suit papers, Mr Flach alleged that after meeting Ms Akoth, they became friends and even started a business together.
He added that he made the complainant a director of his company, German Internet World Ltd, since he was a foreigner before buying land and constructing a storeyed building worth Sh30 million.
The building, he said, contained six high cost apartments, a cyber café, a restaurant and bar.
Mr Flach said that during their love-spell, he bought Ms Akoth two cars and set up a business for her in Nakuru.
