Nairobi — A case has been filed by a mother seeking Sh4 million in compensation from a hospital for alleged negligence on her six-year-old son.
The court allowed Ms Phoeba Atieno’s plea to lodge the case as a pauper and exempted her from paying filing fees.
The exemption was granted after the court was convinced that she could not afford the fees as she is unemployed.
In the suit papers, it is alleged the boy was fine until September 17, 2008, when PCEA Kikuyu Orthopaedic Rehabilitation Centre’s employees administered medication on him to enable him undergo corrective surgery on his knees.
The boy was taken to the theatre where he immediately went into a cardiac arrest after anaestheticians administered some drugs on him.
The mother, who has also sued Dr John King’ori, claims the drugs were administered wrongly and that the doctors failed to take into consideration her son’s feebleness when they ought to have known the drugs could cause the child to have cardiac arrest.
She also faulted the hospital workers for allowing continued use of the drugs despite the boy’s reaction.
The child, who was four years old at the time of the incident, now needs corrective surgery, post-surgical care and attention and a full-time caretaker.
Spend time with boy
The mother also told the court that she lost her job at Sara Lee in Ruaraka, where she was earning Sh9,000 per month because she had been forced to spend time with the boy while in hospital.
Her husband abandoned her after she lost her job, worsening her situation, she says.
And as a result she has the burden of feeding three children.
The case will be mentioned on September 17.
