Ex-Wife Fined for Sending Abusive SMS

A 32-year-old hairdresser was yesterday ordered to pay a fine of Sh20,000 for insulting her former husband by SMS. Lydia Njambi was arraigned before Nanyuki senior principal magistrate Jesse Nyaga accused of misusing a mobile phone. On February 4 at Muramati village in Laikipia district Njambi sent an abusive message to her former husband Boniface Mwaniki.

The mother of two admitted that she sent the text message which read “stopping behaving like a kihii (uncircumcised man) you are too old”. Njambi separated from her 54-year-old husband in 2008. The children’s court granted her custody of their two children. Mwaniki who works at Kirinyaga Construction Company was allowed to visit the children who are aged between three and eight. The court was told that Njambi had been uncomfortable with her ex-husband visiting the children and had sent him abusive text messages.

On the day Njambi sent him the message, Mwaniki had gone to take clothes to the children at school but met Njambi. Though they did not talk, she sent the SMS. Mwaniki reported the matter to the police and the suspect was arrested.

In mitigation the accused pleaded for leniency saying she had young children who depended on her. She said her ex-husband frequently flashed or sent her flashback messages which made her angry leading to her abusing him.

Nyaga ordered her to pay a fine of Sh20,000 or serve a six months jail term.
